d. Lots along the entire length of the northern property line
which have a minimum lot size of 35,000 square feet. In no
case shall a lot line extended above the 390 foot contour.
At least two lots shall be eliminated along this property
line to achieve the requirements of this condition.

e. Interior lots which may be reduced in depth, but increased
in width to provide lot sizes at least as large as the
average indicated on the site plan dated February 7, 1992
(excluding Lot 69). (MM 51)

f. The remainder of the si te plan shall be revised
accordingly, to account for the modifications listed above.
However, in no instance may any lot or indicated building
envelope encroach further into the hill sides or slopes.

Implementation of this condition shall result in the elimination
of at least 14 lots to achieve the General Plan average density
and holding capacity of 51 units for this site. (MM 3a/3d)

8. A homeowners I association shall be created to provide for
landslide/soils maintenance of hillside open space, fire
management of open space areas, maintenance of open space areas
along Foothill Road as created by the project redesign, and
maintenance of the proposed street median islands and all other
common landscape areas.

9. The developer shall grant to the city a conservation easement
over the 44-acre hillside portion of the site. This easement
shall indicate that no additional development is permitted on
the undeveloped hillside portion of the property, and that the
open space is to be maintained in perpetuity, in accordance with
General Plan policies and land use designations. (modification
of MM 3b [part 1])

10. The developer shall grant to the homeowners' association a
public access easement over the emergency vehicle access (EVA)
road which traverses the hillside open space portion of the
site. This access shall grant pedestrian/equestrian right of
trail (EVA) access to the members of the homeowners'
association.

11. The developer shall prepare an open space management program for
the hillside open space area prior to tentative map approval.
The management mechanism shall provide for continued maintenance
of emergency vehicle access roads, fencing at the property
boundaries and at the residential/open space boundaries. It
shall indicate levels of maintenance required, and propose
precise boundaries for land and easement dedication, and
emergency vehicle access rights-of-way through the open space.
This management program shall be administered by the homeowners'
association. (modification of MM 3f)

.
