<br />d. Lots along the entire length of the northern property line <br />which have a minimum lot size of 35,000 square feet. In no <br />case shall a lot line extended above the 390 foot contour. <br />At least two lots shall be eliminated along this property <br />line to achieve the requirements of this condition. <br /> <br />e. Interior lots which may be reduced in depth, but increased <br />in width to provide lot sizes at least as large as the <br />average indicated on the site plan dated February 7, 1992 <br />(excluding Lot 69). (MM 51) <br /> <br />f. The remainder of the si te plan shall be revised <br />accordingly, to account for the modifications listed above. <br />However, in no instance may any lot or indicated building <br />envelope encroach further into the hill sides or slopes. <br /> <br />Implementation of this condition shall result in the elimination <br />of at least 14 lots to achieve the General Plan average density <br />and holding capacity of 51 units for this site. (MM 3a/3d) <br /> <br />8. A homeowners I association shall be created to provide for <br />landslide/soils maintenance of hillside open space, fire <br />management of open space areas, maintenance of open space areas <br />along Foothill Road as created by the project redesign, and <br />maintenance of the proposed street median islands and all other <br />common landscape areas. <br /> <br />9. The developer shall grant to the city a conservation easement <br />over the 44-acre hillside portion of the site. This easement <br />shall indicate that no additional development is permitted on <br />the undeveloped hillside portion of the property, and that the <br />open space is to be maintained in perpetuity, in accordance with <br />General Plan policies and land use designations. (modification <br />of MM 3b [part 1]) <br /> <br />10. The developer shall grant to the homeowners' association a <br />public access easement over the emergency vehicle access (EVA) <br />road which traverses the hillside open space portion of the <br />site. This access shall grant pedestrian/equestrian right of <br />trail (EVA) access to the members of the homeowners' <br />association. <br /> <br />11. The developer shall prepare an open space management program for <br />the hillside open space area prior to tentative map approval. <br />The management mechanism shall provide for continued maintenance <br />of emergency vehicle access roads, fencing at the property <br />boundaries and at the residential/open space boundaries. It <br />shall indicate levels of maintenance required, and propose <br />precise boundaries for land and easement dedication, and <br />emergency vehicle access rights-of-way through the open space. <br />This management program shall be administered by the homeowners' <br />association.
