<br />restriction shall be subject to review and approval by the <br />city Attorney prior to the issuance of building permits for <br />the project and shall be in place prior to occupancy of any <br />units. <br /> <br />7. That the developer shall give rent preference in the new <br />complex to any qualified tenants of the existing rental units <br />on the subject property. In addition, the developer shall use <br />his best efforts to provide assistance to other tenants who <br />are displaced through construction of the new senior <br />apartments. A program for tenant assistance shall be <br />submitted for review and approval by the Planning Director <br />prior to the issuance of building permits for the project. <br /> <br />8. That the applicant shall submit a lighting plan for the <br />parking area for review and approval by the Planning Director <br />prior to the issuance of building permits for the project. <br />The lighting plan shall be designed to minimize the visual <br />impact of the parking lot in the context of the surrounding <br />neighborhood and to minimize the intrusion of light into <br />surrounding properties. <br /> <br />9. That the applicant shall submit a current title report to the <br />City Engineer prior to the issuance of any building permits <br />for this project. <br /> <br />10. That there shall be a concrete curb along the east property <br />line adjacent to the parking lot. <br /> <br />11. That the applicant shall pay his pro-rata share of the cost of <br />undergrounding the existing overhead utility lines across the <br />project frontages (st. Mary street and Division street) as <br />determined by the city Engineer. payment shall be due prior <br />to the issuance of building permits for this project. <br /> <br />12. That the applicant shall reimburse the city for the cost of <br />installing a sanitary sewer lateral for this project. Payment <br />shall be due prior to the issuance of building permits for <br />this project. <br /> <br />13. That the applicant shall dedicate to the City a 5 foot wide <br />strip of land (existing sidewalk) and an 8 foot wide public <br />service easement (PSE) across the Division street frontage of <br />the site. <br /> <br />14. That the developer acknowledges that this approval does not <br />guarantee the availability of sufficient water to serve the <br />project. The city shall withhold building permits for the <br />project if, at the time building permits are applied for, <br />mandatory water rationing is in effect, unless the city has <br />adopted a water offset program and unless the developer is <br />participating in the program. Notwithstanding the developer's <br />participation in such a program, the City may withhold <br />building permits if the City determines that sufficient water <br />is not available at the time building permits for the project <br />are applied for. <br />
