<br />EXHIBIT "A" <br />Resolution No. PC-92-13 <br />Conditions of Approval <br />Case PUD-91-10 <br /> <br />1. That the proposed development shall conform substantially to <br />the site plans, elevations, landscape plan, and related <br />materials, Exhibit A (dated "Received December 6, 1991"), on <br />file with the Planning Department, except: <br /> <br />a. That additional articulation, such as score lines, areas <br />of relief, vertical trim, and/or bay design elements, <br />shall be incorporated on the stucco walls of all <br />elevations, and in particular on the end unit elevations <br />facing Division and st. Mary streets. <br /> <br />b. That additional windows shall be added on the elevations <br />of the end units and elsewhere where deemed by staff to <br />be necessary to relieve blank walls and provide exterior <br />visual interest. <br /> <br />Any significant design-related changes to the plan resulting <br />from the above modifications, as determined by the Planning <br />Director, shall be returned separately for review and approval <br />by the Design Review Board prior to the issuance of building <br />permits for any site work or construction of units. <br /> <br />2. That, except as otherwise modified by the development plan or <br />conditions of approval, the uses and site development <br />standards for the development shall be those of the RM-4,000 <br />zoning district. <br /> <br />3. That, except as modified by these conditions, all <br />recommendations of the arborist's report for the site (dated <br />September 3, 1991) shall be followed during the construction <br />and development phases of the project. <br /> <br />4. That a hose bib shall be added in proximity to the handicap <br />parking stall on the west side of the parking area to provide <br />a location for washing cars. <br /> <br />5. That the design of the proposed "soundwall" along the north <br />and east sides of the parking lot shall be submitted for <br />review and approval by the Planning Director prior to the <br />issuance of building permits for the project. <br /> <br />6. That the 22 apartment units in the development shall be <br />limited to rental by "seniors", as defined by the Department <br />of Housing and Urban Development (HUD). The monthly rent for <br />each unit shall not exceed thirty percent (30%) multiplied by <br />sixty percent (60%) of one-twelfth (1/12th) of the median <br />income level for the Oakland Primary Metropolitan statistical <br />Area (PMSA) as reasonably determined by the Planning Director <br />on an annual basis for a household of one or two persons (as <br />applicable for each unit). These restrictions shall run with <br />the land and shall be formalized through a deed restriction <br />recorded against the property. The details of said <br />
