<br />. <br /> <br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-92-3 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-91-85 FOR BRIAN AND WENDY LYNCH <br /> <br />WHEREAS, Brian and wendy Lynch has applied for a conditional use <br />permit to allow a secondary unit to be installed within <br />an existing single-family residence located at 611 <br />Windmill Lane; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Medium Density Residential District; and <br /> <br />WHEREAS, at their duly noticed public hearing of January 8, 1992, <br />the Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The proposed secondary unit is located in a PUD-MDR <br />district which conforms to the regulations <br />specified in the code for an R-1-10, 000 zoning <br />district. The request to establish a secondary <br />unit in a single-family residential district <br />conforms to the objectives of the Zoning Ordinance <br />and the purpose of the one-family residential <br />district. These districts are intended to preserve <br />lower population densities than mUlti-family <br />residential districts, and special consideration <br />may be given to issues which may effect privacy, <br />traffic volumes and design. The proposed unit does <br />not alter the exterior of the existing house, is <br />small in size, and integrates well within the <br />existing home. This helps maintain the single- <br />family character of the neighborhood. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, and welfare, or materially <br />injurious to the properties in the vicinity. <br /> <br />The following issues must be considered within the <br />scope of public health, safety and welfare: <br />
