<br />archaeological remains are encountered during construction, <br />construction in the vicinity shall be halted, the <br />archaeologist consulted, and the Planning Department notified. <br />If, in the opinion of the archaeologist the remains are <br />significant, measures as may be required by the Planning <br />Director shall be taken to protect them. <br /> <br />7. A qualified arborist or horticultural consultant shall <br />meet on-site with the grading contractor and crew, prior to <br />the commencement of grading, to clearly identify and mark <br />trees which shall be preserved, as well as their driplines. <br />Consultant shall also instruct the contractor and crew on <br />measures which must be taken to preserve trees during <br />earthmoving activity. The qualified arborist or horticultural <br />consultant shall remain on-site during grading and <br />construction to ensure that measures specified in the approved <br />tree protection plan are properly implemented. No trees or <br />areas marked for protection by the consultant shall be damaged <br />or removed without the specific approval of the Director of <br />Public Works. If trees designated to be preserved are damaged <br />or removed during the course of construction activities, they <br />shall be replaced at a ratio of 5 to 1, at a minimum 15 gallon <br />size. <br /> <br />8. Compliance with the construction grading plan, and <br />assurance that grading will be completed satisfactorily <br />(brought to a stable and erosion resistant state) in the event <br />the project is prematurely terminated, shall be guaranteed in <br />an amount and manner determined suitable by the Director of <br />Public Works. said guarantee shall be provided to the City, <br />prior to issuance of grading permit. Grading proposed to <br />extend beyond the limits of a final subdivision map, shall <br />also be protected by the aforementioned guarantee. <br /> <br />9. No grading of the site shall occur between October 1 and <br />April 15 of any year, without the prior approval of the <br />Director of Public Works. Said approval may be granted, upon <br />proof by the project soils engineer, that grading during the <br />winter will not create erosion or sedimentation problems off- <br />site. <br /> <br />10. Grading and construction activities, including vehicle <br />access and equipment storage, shall be limited to portions of <br />the site which are designated on the grading plans to be <br />disturbed. <br /> <br />11. Grading activities shall be limited to between the hours <br />of 7:00 a.m. and 6:00 p.m., Monday through Saturday. Once any <br />units on the site are occupied, grading and construction shall <br />be limited to weekdays between 8:00 a.m. and 6:00 p.m. <br />Maintenance of construction equipment may occur any day <br />between the hours of 7: 00 a.m. and 8: 00 p.m. If, in the <br />opinion of the Director of Public Works, noise becomes a <br />problem in the evening hours between 6:00 p.m. and 8:00 p.m., <br />
