<br />a. certain nuisances, associated with agricultural <br />practices both on-site and on adjacent properties, may affect <br />project residents. Potential nuisances include, but are not <br />limited to, noise, odor, dust, chemicals and other sprays, <br />insects, and rodents; <br />b. Legal agricultural activities will not be curtailed <br />as the result of the introduction of residential uses into the <br />area; <br />c Property owners, their invitees, guests, and agents <br />assume the risk of living or working adjacent to landowners <br />involved in agricultural practices and bear the duty to <br />educate and inform themselves, invitees, guests, and agents of <br />the dangers involved in trespassing on adjacent landowners' <br />property, and restrictions exist on keeping of certain types <br />of animals on the properties. <br /> <br />Notification of the information discussed above shall be given <br />by the developers, their assignees or transferees and the <br />homeowners' association, its representatives, agents, or <br />managers, through the following means: deeds, CC&R's, and <br />leases, title reports, and posting of signs and/or notices; <br />and/or distribution of flyers informing property owners of <br />specially scheduled occurrences which may be perceived as <br />nuisances, (e.g. periodic chemical spraying). Further, the <br />Alameda county Right-to-Farm Ordinance, in its entirety, shall <br />be attached to all deeds, leases, and CC&R's. Failure to <br />notification (i.e., non-disclosure) will not affect the title <br />nor recording of any document, but may subject the seller or <br />lessor or their respective agent to civil action by the <br />purchaser or lessee, for any damages incurred as a result of <br />nondisclosure. <br /> <br />This notification also shall be provided to guests, members or <br />invitees of the golf club by the golf club's owner, managing <br />agent or representative, through posting a notice in a <br />conspicuous place in the clubhouse or other means. <br /> <br />4. Prior to first occupancy of a residential unit within any <br />Final Map area, a landscape and lighting district (LLD) and/or <br />homeowners' association shall be formed to accomplish the <br />following functions at no cost to the City: <br />a. Maintain permanent drainage, erosion control and <br />water quality facilities; <br />b. Inspect and maintain slopes and facilities, prior to <br />October 1 of each year; <br />c. Repair any mass soil movement or erosion involving <br />common area property; <br />d. Maintain common areas, fire buffer, undeveloped open <br />space, and the Foley buffer; <br />e. Maintain street lighting; <br />f. Maintain all project streets and parking areas; <br />
