The developer shall be responsible for maintenance of all <br />landscaping installed by the developer for one year beyond <br />installation. Thereafter, the Landscapinq and Liqhtinq <br />District (LLD) or POA shall be responsible for maintenance of <br />common areas. <br /> <br />4. Prior to Council approval of a Final Map(s), the <br />developer shall submit to the Planning Director for review and <br />approval a set of Landscape Design Guidelines for individual <br />property owners. These guidelines shall include standards and <br />locations for open and solid privacy fencing, location of <br />private pools, tennis courts and other accessory structures. <br />The guidelines shall emphasize water conservation and <br />compatibility of plant types with the terrain, climate, <br />natural setting of this site. <br /> <br />.!L.. PROPERTY-OWNERS' ASSOCIATION AND NOTIFICATION TO PROPERTY- <br />OWNERS <br /> <br />1. Prior to filing of a Final Map(s), a master property <br />owners' association (POA) encompassing all development and <br />common areas in this project shall be formed or guaranteed. <br />However, if common areas, such as the undeveloped open space <br />and private recreational areas are in individual lot ownerShip <br />or owned by a pUblic entity, then the Planning Director, at <br />his discretion, may waive the requirement for a master <br />property owners' association. Condi tions, Covenants and <br />Restrictions (CC&R's) shall be approved by the Planning <br />Director and shall, at a minimum, include the following: <br />a. Payment of dues and assessments shall be both a lien <br />against the assessed land and a personal obligation of each <br />property owner. <br />b. POA's shall maintain public liability insurance <br />indemnifying the city against liability for personal injury or <br />property damage caused by or resulting from development or <br />improper maintenance of the project. <br />c. CC&R's shall require that common areas and private <br />properties be maintained in good repair. <br />d. Parking shall be allowed in designated locations <br />only and streets shall be so posted. POA's shall enforce <br />these restrictions. <br />e. In single family residential areas, parking or <br />storage of recreational vehicles or trailer-haul routes shall <br />be subject to the regulations of the City County Zoning <br />Ordinance. <br />f. For all private lots, property owners shall install <br />and maintain landscaping, private storm dra,inage, and any <br />necessary engineering measures for slope stability to prevent <br />and repair mass soil movement and erosion occurring on private <br />property.
