The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public heath, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. Given the proposed location of loading activities and the existing screening for the area proposed for outdoor storage, the use will not negatively impact the surrounding uses. Other similar uses in the area have been approved by the Planning Commission and have not caused any reported problems. C. The proposed conditional use will comply with each of the applicable provisions of the zoning ordinance. Chapter 18.124 ofthe Zoning Ordinance states that, because of their unusual characteristics, conditional uses require special consideration so that they may be located properly with respect to their effects on surrounding properties. The recommended conditions of approval will help to integrate the proposed use without detrimentally affecting the surrounding properties of the City in general. As conditioned, the proposed use will comply with all provisions and requirements of the City's zoning ordinance. WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will be compatible with the surrounding uses and properties. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-95-74, the application of On-Top Construction for a conditional use permit to operate a contractor's warehouse at 2126 Rheem Drive, subject to the conditions shown in Exhibit "B," attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time. II II I I . I
