<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-95-87 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF STEVEN SLIPKA FOR A <br />CONDITIONAL USE PERMIT TO ESTABLISH A SECONDARY UNIT AS FILED <br />UNDER CASE UP-95-51 <br /> <br />WHEREAS, Steven Slipka has applied for a conditional use permit to establish a secondary <br />unit within a single-family home located at 4074 Suffolk Way; and <br /> <br />WHEREAS, zoning for the property is R-I-6,500 (single-family residential) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of November 8, 1995, the Planning <br />Commission considered all public testimony, relevant exhibits and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission reviewed staff's findings as stated in the Staff Report <br />prepared for Case UP-95-51, dated November 8, 1995, and made the following <br />findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The primary objective of Chapter 18.04 of the Municipal Code, "General <br />Provisions," is to protect and promote the public health, safety, peace, <br />comfort, convenience, prosperity and general welfare. In addition, <br />objectives of the R-l residential district include achieving appropriately <br />located areas for family living at reasonable population densities consistent <br />with sound standards of public health and safety, minimizing traffic <br />congestion, and providing sufficient parking. <br /> <br />The City of Pleasanton has not adopted an ordinance which regulates <br />secondary units, therefore, secondary units are subject to the provisions <br />of state law. Consistent with this law, a conditional use permit must be <br />approved to establish a secondary unit in the City of Pleasanton. The <br />subject use permit meets the State requirements which specify guidelines <br />that act as maximum requirements for communities to use in the <br />evaluation of secondary units. The secondary unit conforms to these <br />requirements, will not exceed the allowable density, and is consistent with <br />the General Plan and zoning for the lot. <br /> <br />II <br /> <br />. <br />
