That all improvements shall substantially conform to Exhibit "A" (floor plan), dated <br />"Received August 18, 1995," on file with the Planning Department, except as modified <br />by the following conditions. <br /> <br />2. That if the operation of this use results in conflicts pertaining to parking, traffic, or other <br />impacts, at the discretion of the Planning Director, this use permit may be submitted to <br />the Planning Commission for subsequent review at a public hearing. If necessary, the <br />Commission may modify or add conditions of approval to mitigate such impacts, or may <br />revoke said use permit. <br /> <br />3. The side yard entrance to the secondary unit shall not be used between the hours of 10:00 <br />p.m. and 6:00 a.m. The tenant(s) of the secondary unit shall use the entrance to the <br />primary dwelling unit or the garage door as a means to gain access to the unit. <br />Compliance with this condition of approval shall be reviewed six (6) months from the <br />date of project approval. <br /> <br />4. The applicant shall install cutoff shields on the existing side yard entryway lights to <br />redirect the light away from the Cassens bedroom windows, or shall install new light <br />fixtures with shields or other design features which reduce and cut off light and glare, <br />to the satisfaction of the Planning Director. The new light fixtures or shields shall be <br />installed within two weeks of approval of this use permit. <br /> <br />5. The applicant shall obtain all the necessary City permits to legalize the existing spa and <br />deck. The applicant shall secure these permits within thirty (30) days from the date of <br />project approval. The self-latching gate around the spa shall be installed within two <br />weeks of approval of this use permit. <br /> <br />6. That the applicant obtain all the necessary City permits for the construction of the <br />secondary unit. <br /> <br />7. Only one residential unit on the subject property may be rented. The other unit shall be <br />owner-occupied at all times. With regards to the secondary unit, the unit shall be <br />occupied by no more than two adults, although there shall be no limit on the number of <br />children. The applicant shall prepare the restriction to this effect and shall submit it to <br />the City Attorney within thirty (30) days of approval of this use permit for review and <br />approval prior to recordation. <br /> <br />II <br /> <br />. <br />
