PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-95-87

RESOLUTION APPROVING THE APPLICATION OF STEVEN SLIPKA FOR A
CONDITIONAL USE PERMIT TO ESTABLISH A SECONDARY UNIT AS FILED
UNDER CASE UP-95-51

WHEREAS, Steven Slipka has applied for a conditional use permit to establish a secondary
unit within a single-family home located at 4074 Suffolk Way; and

WHEREAS, zoning for the property is R-1-6,500 (single-family residential) District; and

WHEREAS, at their duly noticed public hearing of November 8, 1995, the Planning
Commission considered all public testimony, relevant exhibits and
recommendations of the City staff concerning this application; and

WHEREAS, the Planning Commission reviewed staff's findings as stated in the Staff Report
prepared for Case UP-95-5l, dated November 8, 1995, and made the following
findings:

A. The proposed location of the conditional use is in accordance with the
objectives of the zoning ordinance and the purpose of the district in which
the site is located.

The primary objective of Chapter 18.04 of the Municipal Code, "General
Provisions," is to protect and promote the public health, safety, peace,
comfort, convenience, prosperity and general welfare. In addition,
objectives of the R-l residential district include achieving appropriately
located areas for family living at reasonable population densities consistent
with sound standards of public health and safety, minimizing traffic
congestion, and providing sufficient parking.

The City of Pleasanton has not adopted an ordinance which regulates
secondary units, therefore, secondary units are subject to the provisions
of state law. Consistent with this law, a conditional use permit must be
approved to establish a secondary unit in the City of Pleasanton. The
subject use permit meets the State requirements which specify guidelines
that act as maximum requirements for communities to use in the
evaluation of secondary units. The secondary unit conforms to these
requirements, will not exceed the allowable density, and is consistent with
the General Plan and zoning for the lot.

II

I
