Resolution No. PC-95-78
Page 13

b. The property for the water tank shall be dedicated in fee
to the City. If the location of the tank is on adjacent
property, the developer shall attempt to acquire that
portion of the property, or request its dedication.
Should the developer be unable to acquire or have
dedicated such property, the City may use its right of
eminent domain. The applicant shall reimburse to the
City any cost incurred in the property acquisition.

c. The applicant shall pay a pro-rata share of the design
and construction of a new pump station with the full
maximum day capacity, to be located adjacent to the
existing Foothill/Stoneridge tank. The pump station
shall include a diesel generator large enough to allow
pumping of the new zone during maximum day demand.

d. The developer shall bear the full cost of the
installation of the water reservoir and all necessary
telemetry, water mains, pressure reducing stations etc.,
including land and easement acquisition. The developer
may enter into a reimbursement agreement with the City to
recover pro-rata reimbursement from other benefitting
properties.

e. The developer shall install a 12-inch "low zone" ("390")
water line, from Muirwood Drive to Highland Oaks Drive or
portion thereof, the estimated construction cost of which
(based upon 1990 sfr-enr-cci of 2,000 feet) should not
exceed $180,000. This water line shall be installed
prior to any construction in Tract 6590, or in Tract
6400, whichever contains the second phase of development.
The developer may enter into a reimbursement agreement
with the City to recover pro-rata reimbursement from
other benefitting properties.

f. The developer shall install a 12 inch water main in:
Laurel Creek Drive between Dublin Canyon Road and the
southerly boundary of the property; Blessing Drive
between Laurel Creek Drive and Tillman Drive; Tillman
Drive and the access road between the proposed reservoir
and Blessing Drive; and between the proposed pump station
at the existing Foothill reservoir and Laurel Creek
Drive. A twelve-inch ductile iron water line shall be
installed within or along the EVAE road between MacDonald
Court and Olson Court.

Where the static pressure exceeds 100 psi (elevations
below approximately 550 feet), ductile iron pipe water
mains, saddles for service connections and polyethylene
tubing with a pressure rating of 200 psi shall be used
unless otherwise approved by the City Engineer.
