<br />Resolution No. PC-95-77 <br />Page 3 <br /> <br />The design of the gazebo -- featuring wood posts <br />and beams and a wood shake roof would, in <br />staff's opinion, visually complement the character <br />of the surrounding neighborhood. <br /> <br />The gazebo would be a passive use of this portion <br />of the applicants' rear yard; the privacy of <br />adjacent homes and yards would not be impacted. <br /> <br />The applicants will have to apply for and receive a <br />building permit for the gazebo to ensure that its <br />construction conforms to the applicable <br />requirements of the Uniform Building Code. <br /> <br />A row of cypress trees, planted on an approximately <br />10' 0" spacing, is located along the applicants' <br />rear property line. when fully grown, these trees <br />will screen the view of the gazebo from off-site <br />properties. <br /> <br />As required by the Zoning Administrator's action, <br />the applicants shall install one 15 gallon <br />evergreen pear tree on their property in the area <br />between the gazebo and the existing cypress trees. <br />The evergreen pear tree will augment the screening <br />already provided by the cypress trees. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the gazebo in its <br />present location is a logical and appropriate use in this <br />area of the applicant's yard and that the overall visual <br />impact of the gazebo to the Cravotta property would be <br />negligible. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Denies Case AP-95-10 and approves Case V-95-15j <br />Z-95-168, the application of Robert and Suzanne Ernest <br />for a variance from the Pleasanton Municipal Code and for <br />design review approval to allow an existing, <br />approximately 15' 0" tall open gazebo within the required <br />front yard of a single-family lot located at 17 Foothill <br />Lane, subject to the conditions shown on Exhibit "B" <br />attached hereto and made part of this case by reference. <br /> <br />. <br />
