<br />Resolution No. PC-95-77 <br />Page 2 <br /> <br />The curved alignment of the applicants' front <br />property line, bowed-in towards the site, "pushes" <br />the front setback line into the private rear/side <br />yards to a location approximately 15' 0" behind the <br />fence separating the front and rear/side yard <br />areas. The location of the front building setback <br />line behind the front yard fence of the applicants' <br />property, caused by an unusually configured front <br />property line, limits the use and control of their <br />private yard areas. <br /> <br />Because of the unusual lot configuration, requiring <br />the applicants to abide by the requirements of the <br />Pleasanton Municipal Code in this case, <br />requiring the gazebo to be set back 25' 0" from the <br />front property line on Foothill Lane would <br />restrict their use and enjoyment of the private <br />rear and side yard areas of their property. <br />Additionally, moving the gazebo 5' 0" farther back <br />into the rear yard of the applicants' site would <br />decrease its present separation -- 14' 0" -- from <br />the site's rear property line, thus moving it <br />closer to the Cravottas' property line. <br /> <br />2. Granting the variance will not constitute a grant <br />of special privilege for the applicants, <br />inconsistent with the limitations on other <br />properties classified in the same zoning district. <br /> <br />The gazebo is located behind the front yard fence. <br />Other nearby properties zoned R-1-20,000, as well <br />as R-1-20,000 zoned properties in the overall City, <br />have detached accessory structures located behind <br />front yard fences in private yards. <br /> <br />As previously stated, the configuration of the <br />site's front yard building setback line places a <br />unique limitation on the applicants' use of the <br />private rear/side yard areas of their property. <br /> <br />Granting the variance would not constitute a <br />special privilege to the applicants, inconsistent <br />with the limitation of the other nearby R-1-20,000 <br />zoned properties. <br /> <br />3. Granting the variance will not be detrimental to <br />the public health, safety or welfare, or materially <br />injurious to properties or improvements in the <br />vicinity. <br />
