<br />Resolution No. PC-95-76 <br />Page 4 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case UP-95-54 <br /> <br />1. The beermaking operations of the subject use are contingent <br />upon adoption of City Council Ordinance No. 1665, and shall <br />not be established until the effective date of that ordinance. <br /> <br />2. The location and operation of the proposed use shall conform <br />substantially to Exhibit A (the site plan, floor plan, and <br />details of operation), dated "Received September 16, 1995"), <br />on file with the Planning Department, except as modified by <br />these conditions. <br /> <br />3. The operation of the brew pub shall be limited to the <br />following hours: 6: 30 a. m. to 9: 30 a. m. for beermaking <br />activities, and from 10:00 a.m. to 10:00 p.m., Monday through <br />Wednesday, 10:00 a.m. to 11:00 p.m., Thursdays, 10:00 a.m. to <br />12 midnight, Friday and Saturdays, and from 10:00 a.m. to <br />10:00 p.m. on Sundays for alcohol sales. <br /> <br />4. The use of the rear outdoor deck area shall be limited to <br />daylight hours only. <br /> <br />5. In the event that the applicant proposes to modify the hours <br />or other aspects of the business operation, or modify the <br />exterior building or site, the modification shall be subject <br />to the review of the Planning Director. The Planning Director <br />may approve the modification or refer the matter to the <br />Planning Commission if judged to be substantial. <br /> <br />6. The applicant shall maintain the area surrounding the brew pub <br />tenant space, outdoor deck areas, and parking lot in a clean <br />and orderly manner at all times. The applicant shall monitor <br />the area outside the brew pub to ensure peace and quiet. In <br />the event that nuisances are created through the operation of <br />the brew pub, either within the brew pub itself or by its <br />patrons in the vicinity of the brew pub, the Planning Director <br />may refer the conditional use permit to the Planning <br />Commission for review at a public hearing. If necessary, the <br />Planning Commission may add additional conditions of approval <br />or may revoke the conditional use permit. <br /> <br />7. If operation of this use results in conflicts pertaining to <br />parking, interior or exterior noise, traffic/circulation, <br />litter, odors, loitering, fighting, or other factors, at the <br />discretion on the Planning Director, this conditional use <br />permit may be submitted to the Planning Commission for their <br />subsequent review at a public hearing. If necessary, the <br />Commission may modify or add conditions of approval to <br />mitigate such impacts, or may revoke said conditional use <br />
