<br />Resolution No. PC-95-63 <br />Page 3 <br /> <br />as housewares and clothing, the applicant is not <br />proposing to operate as a consignment store, so <br />items would not be accepted directly from customers <br />wishing to sell, and there would be no "drop-off" <br />of items to be sold. The appl icant intends to <br />purchase used items elsewhere and bring them to her <br />store, similar to any other retailer ordering or <br />purchasing new items to sell. Therefore, the store <br />would appear and operate as a typical retail store, <br />and it would not be outwardly apparent that the <br />store was selling used items. The store would not <br />subject surrounding uses to heavy truck traffic, <br />hazardous conditions, or other obj ectionable <br />influences. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />The site's Central Commercial zoning conditionally <br />permi ts the establ ishment of stores which sell <br />secondhand goods. In addition, the proposed use <br />complies with all relevant sections of the zoning <br />ordinance. Granting a conditional use permit to <br />the applicants would be consistent with the city's <br />ability to regulate zoning as listed in the <br />Municipal Code Chapter 18.124. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed use <br />is compatible with other retail uses in the Downtown and <br />that the conditions of approval will ensure the safety <br />and general welfare of the surrounding neighborhood. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-95-53, the application of Michelle st. <br />John-Biddle for a conditional use permit to operate a <br />retail store selling secondhand kitchenwares, home <br />decorating items, art work, and clothing as part of a <br />retail store selling new items located at 690-A Main <br />street, subject to the conditions shown on Exhibit "B" <br />attached hereto and made part of this case by reference. <br /> <br />section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
