The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. The proposed health club would be contained completely on-site. Sufficient parking and traffic capacity have been provided. The soundproofing to the suite should be adequate to reduce any potential negati ve impacts on the adj acent residents and/or tenants. Streets leading to the site are designed per City standards and are signalized to provide safe access into and out of the site. The conditions of approval, as well as the applicant's design of the tenant space the use will occupy, will ensure that the establishment remains within the standards of all applicable City codes. C. That the proposed conditional use will comply with each of the applicable provisions of this chapter. The site's PUD zoning permits the establishment of gymnasiums and health clubs including massage. The proposed health club complies with all relevant sections of the zoning ordinance. Granting a conditional use permit to the Vintage Hills Health Club to operate a health club is consistent with the City's ability to regulate zoning as listed in Municipal Code Section 18.124 "Conditional Uses." WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning Commission determined that the proposed use, as conditioned, would provide a personal improvement service which could be a benefit for the citizens of Pleasanton. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-95-38, the application of Mark Stoklosa (Vintage Hills Health Club) for a conditional use permit to operate a health and fitness club at an existing vacant 20,000 square foot tenant space located at the Vintage Hills Shopping Center, 3350 Bernal Avenue, subject to the conditions shown on Exhibit "B" attached hereto and made part of this case by reference.
