The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposed health club would be contained <br />completely on-site. Sufficient parking and traffic <br />capacity have been provided. The soundproofing to <br />the suite should be adequate to reduce any <br />potential negati ve impacts on the adj acent <br />residents and/or tenants. Streets leading to the <br />site are designed per City standards and are <br />signalized to provide safe access into and out of <br />the site. The conditions of approval, as well as <br />the applicant's design of the tenant space the use <br />will occupy, will ensure that the establishment <br />remains within the standards of all applicable City <br />codes. <br /> <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of this chapter. <br /> <br />The site's PUD zoning permits the establishment of <br />gymnasiums and health clubs including massage. The <br />proposed health club complies with all relevant <br />sections of the zoning ordinance. Granting a <br />conditional use permit to the Vintage Hills Health <br />Club to operate a health club is consistent with <br />the City's ability to regulate zoning as listed in <br />Municipal Code Section 18.124 "Conditional Uses." <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, <br />as conditioned, would provide a personal improvement <br />service which could be a benefit for the citizens of <br />Pleasanton. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-95-38, the application of Mark <br />Stoklosa (Vintage Hills Health Club) for a conditional <br />use permit to operate a health and fitness club at an <br />existing vacant 20,000 square foot tenant space located <br />at the Vintage Hills Shopping Center, 3350 Bernal Avenue, <br />subject to the conditions shown on Exhibit "B" attached <br />hereto and made part of this case by reference. <br />
