Resolution No. PC-95-48
Page 2

proposed use is in keeping with purposes of the C-S
District.

2. The proposed location of the conditional use and
the conditions under which it would be operated or
maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious
to the properties or improvements in the vicinity.

Given the proposed activities and hours of
operation for the subject use, it will not impact
surrounding uses. Any areas of possible concern
have been conditioned so that the proposed use will
meet all applicable Municipal Code requirements.
The applicants can also be required to mitigate any
future nuisances or problems. If all the
conditions of approval are complied with the
proposed retail landscape and masonry yard will not
detrimentally impact the surrounding properties.

3. The proposed conditional use will comply with each
of the applicable provisions of this chapter.

Chapter 18.124 of the Municipal code (Conditional
Uses) states that, because of their unusual
characteristics, conditional uses require special
consideration so that they may be located properly
with respect to their effects on surrounding
properties. Conditions of approval integrate the
proposed use without detrimentally affecting the
surrounding properties or the City in general. The
proposed use will also comply with all provisions
and requirements of the City's zoning ordinance.

WHEREAS, projects of this nature are categorically exempt from the
requirements of the California Environmental Quality Act
(CEQA); and

WHEREAS, the Planning Commission determined that the proposed use,
as conditioned, would be compatible with the surrounding
uses and properties.

.
