Resolution No. PC-95-46 Page 5 EXHIBIT "B" Conditions of Approval Case UP-95-36 1. Development shall be substantially as shown on the site plan, landscape plan, building floor plans and elevations, and operation statement, Exhibit "A", dated "Received July 7, 1995" on file with the Planning Department, except as modified by the following conditions. Minor changes to the plans may be allowed subject to the approval of the Planning Director if found to be in substantial conformance to the approved exhibits. 2. The applicant shall ensure that one employee at the espresso stand is stationed outside the espresso stand, regardless of weather, during peak operating hours or when more than three vehicles are waiting at one of the drive-through lanes. The employee shall direct traffic, take orders, etc., in order to expedite traffic through the espresso stand. 3. The applicant shall effectively screen from view all ducts, meters, air conditioning equipment, and any other mechanical equipment, whether on the structure, on the ground, or on the roof, with materials architecturally compatible with the main structure. Screening details shall be shown on the plans submitted for issuance of building permits, the adequacy of which shall be determined by the Planning Director. 4. All mechanical equipment shall be operated in such a manner that noise emanating from it will not be perceptible beyond the building plane of the espresso stand. 5. All trash and refuse shall be contained completely within the espresso stand. The applicant shall be responsible for maintaining the area surrounding the espresso stand in a clean and orderly manner at all times. 6. Signing for the espresso stand shall conform to the sign program shown on the building elevations. 7. All utilities required to serve any existing or proposed development on-site shall be installed underground, unless otherwise determined by the City Engineer. 8. The applicant shall enter into an agreement with the City, approved by the City Attorney, which guarantees that all landscaping and open space areas included in this project will be maintained at all times in a manner consistent with the approved landscape plan for this development. Said agreement shall run with the land for the duration of the existence of the structures located on the subject property.
