<br />Resolution No. PC-95-45 <br />Page 2 <br /> <br />Outdoor storage yards are a common use along Old <br />Santa Rita Road. With conditions limiting the <br />duration of the use permit, and regulating the <br />applicant's vehicle parking and outdoor uses, the <br />use can be accommodated without adverse impacts on <br />the other uses in the general vicinity. <br /> <br />3. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />Chapter 18.124 of the Municipal code (Conditional <br />Uses) states that, because of their unusual <br />characteristics, conditional uses require special <br />consideration so that they may be located properly <br />with respect to their effects on surrounding <br />properties. Conditions of approval integrate the <br />proposed use without detrimentally affecting the <br />surrounding properties or the City in general. The <br />proposed use will also comply with all provisions <br />and requirements of the City's zoning ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, <br />as conditioned, would be compatible with the surrounding <br />uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-95-24, the application of U.S. Towing <br />(Jagtar Gill) for a conditional use permit to operate a <br />tow company storage yard and office located at 3932 Old <br />Santa Rita Road, subject to the conditions shown on <br />Exhibit "B" attached hereto and made part of this case by <br />reference. <br /> <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
