With conditions limiting the duration of the use permit, and regulating the applicant's vehicle parking and outdoor uses, the use can be accommodated without adverse impacts on the other uses in the general vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this chapter. Chapter 18.124 of the Municipal code (Conditional Uses) states that, because of their unusual characteristics, conditional uses require special consideration so that they may be located properly with respect to their effects on surrounding properties. Conditions of approval integrate the proposed use without detrimentally affecting the surrounding properties or the City in general. The proposed use will also comply with all provisions and requirements of the City's zoning ordinance. WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning Commission determined that the proposed use, as conditioned, would be compatible with the surrounding uses and properties. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-95-24, the application of U.S. Towing (Jagtar Gill) for a conditional use permit to operate a tow company storage yard and office located at 3932 Old Santa Rita Road, subject to the conditions shown on Exhibit "B" attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
