The proposed development shall conform substantially to the site <br />plan, floor plan, elevations, colors/material board, and related <br />materials, Exhibit A (dated "Received" June 19, 1995), on file with <br />the Planning Department, except as modified by these conditions. <br />Minor changes to the plans may be allowed subject to the approval <br />of the Planning Director if found to be in substantial conformance <br />with the approved exhibits. <br /> <br />2. If desired by the adjacent property owner to the west (ISO Spring <br />Street), the applicant shall remove the two existing trees <br />(identified as Tree Nos. 5 and 6 in the tree report prepared by <br />HortScience dated March 28, 1988) and replace them with 24 in. box <br />sized trees. Replacement tree species shall be mutually agreed <br />upon by the adj acent property owner, applicant, and Planning <br />Director. Said trees shall be installed by the applicant prior to <br />receiving final occupancy of the apartment units. The applicant <br />shall not be responsible for installing irrigation system(s) for <br />the new trees. <br /> <br />3. Any pruning of existing trees shall be performed by a certified <br />arborist. The applicant shall notify the adjacent property owner <br />of 180 Spring Street prior to pruning any of the existing trees. <br /> <br />4. The applicant shall construct both the commercial/office and <br />apartment buildings at the same time. Final occupancy of the <br />apartment building shall not be granted unless the <br />commercial/office building is under construction and diligently <br />pursued towards completion. <br /> <br />5. The proposed fencing along the western property line shall be <br />adjusted, as necessary, around the existing trees. Fence posts <br />shall be placed as far as possible from the tree trunks. A final <br />fencing plan shall be submitted to and approved by the Planning <br />Director as part of the building permit plan set prior to issuance <br />of an on-site permit <br /> <br />6. A final landscape plan and irrigation plan shall be submitted to <br />and approved by the Planning Director as part of the building <br />permit plan set prior to issuance of an on-site permit. Said <br />landscape plan shall include an indication of plant sizes, numbers, <br />and spacing in the indicated landscape areas. The final landscape <br />plans shall meet the requirements of the Water Conservation <br />Ordinance in effect at the time of issuance of a building permit <br />for the site.
