<br />EXHffiIT "B" <br />CONDITIONS OF APPROVAL <br />VESTING TENTATIVE MAP 6728, ST. JOHN'S PLACE <br /> <br />1. Development shall be substantially as shown on the Vesting Tentative Tract Map, Exhibit <br />"A", dated "Received May 19, 1995" on file with the Planning Department, except as <br />modified by these conditions. Minor alterations may be approved by the Planning Director <br />iffound to be in substantial compliance with this approval. <br /> <br />2. All conditions of approval for PUD-94-04 shall remain in effect and in full force and are <br />herein incorporated by reference. <br /> <br />3. The public street configuration shown on the improvements plans submitted in conjunction <br />with a final map shall reflect the 48 foot wide street cross-section shown on the Tentative <br />Tract Map 6728, referenced in Condition No.1, and shall be reviewed and approved by <br />the Planning Director prior to final map approval. <br /> <br />4. The developer shall be responsible for extending the storm drain system across the St. <br />John Street frontage. This detail shall be shown on the improvement plans submitted in <br />conjunction with the final map and shall be reviewed and approved by the City Engineer. <br /> <br />5. Prior to final map approval, the color and texture ofthe concrete creek trail and the color <br />and material of the creek trail retaining walls shall be submitted to the Planning Director <br />for review and approval. In general, the concrete creek trail and retaining walls shall be <br />designed to be natural earth tone colors and shall incorporate graffiti maintenance removal <br />materials or finishes. <br /> <br />6. The CCR's for the project shall require that the homeowners association be responsible <br />specifically for cleaning of graffiti along the creek trail. Clean-up shall be completed within <br />seven days. <br /> <br />7. In lieu of making the south-side creek trail handicap accessible, the developer shall be <br />responsible for extending the existing north-side creek trail by placing an asphalt overlay <br />on the existing sub-base from the trail's current easterlymost terminus to the railroad <br />bridge crossing of the Arroyo Del Valle. The developer shall make a good faith effort in <br />securing the necessary approvals from the current property owners to allow for the <br />extension ofthe trail. The City shall assist the developer in obtaining the necessary <br />approvals. In the event that the developer is unable to obtain the required approvals, the <br />developer shall submit a cash payment equivalent to this required work which the City <br />shall use for the sole purpose of improving the north-side creek trail to meet handicap <br />accessibility standards. An estimate and plan for this work shall be submitted in <br />conjunction with the improvement plans for the final map. Prior to occupancy of fifty-one <br />(51) percent of the units, the creek trail shall either be installed or payment shall be made <br />to the City of Pleasanton. <br />
