PLANNING COMMISSION CITY OF PLEASANTON
ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-95-36

RESOLUTION APPROVING THE APPLICATION OF
VRANEK (EARLY YEARS CHILDREN'S CENTER)
DESIGN REVIEW APPROVAL, AND A VARIANCE,
UP-95-03, Z-95-13, AND V-95-07

FRANK AND SHERYL
FOR A USE PERMIT,
AS FILED UNDER CASE

WHEREAS, Frank and Sheryl Vranek (Early Years Children's Center)
have applied for a use permit and design review approval
to construct an approximately 3,477 square foot building
to be utilized for additional classroom area, and a
variance for a fence in the front yard setback, at the
Early Years Children's Center located at 1251 Hopyard
Road; and

WHEREAS, zoning for the property is R-1-6,500 District; and

WHEREAS, at its duly noticed public hearing of June 14, 1995, the
Planning Commission, after considering all public
testimony, relevant exhibits, and recommendations of the
City staff concerning this application, approved the
negative declaration for this project; and

WHEREAS, the Planning Commission made the following use permit
findings:

A. The proposed location of the conditional use is in
accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

The City's Municipal Code permits the establishment
of nursery schools in residential areas with
approval of a use permit. The term "nursery
schools" is interpreted to include the more modern
day care center catering to children of various
ages. Day care centers, with their need for
substantial yard areas, are an appropriate use for
a residential area. Childcare centers typically do
not generate a substantial amount of traffic and,
the majority of drop-off and pick-up will occur
during the early morning and early evening "rush
hours" as parents are going to work or returning
from work. These "high volume" hours are typical
of any residential neighborhood. Furthermore, the
center is located on the periphery of a residential
area on a maj or street, so traffic through the
adjacent streets will be avoided.
