Resolution No. PC-95-32 Page 2 Several conditions have been included which would restrict the hours of operation to minimize noise and odor impacts, thereby ensuring that the use will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. C. The proposed conditional use will comply with each of the applicable provisions of this chapter. The home occupation is required to comply with the conditions of this use permit and those stipulated in Chapter 18.104.30. Additionally, other conditions for the operation of the home occupation have been included which further ensure compliance with the zoning ordinance and its objectives. As with any use permit, the home occupation permit can be suspended or revoked if the conditions are not met. WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning Commission finds that the proposed use, as conditioned, is acceptable. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-95-21, the application of David Conkle for a non-exempt home occupation permit to allow the establishment of a small engine service and repair business to be conducted from the existing residence located at 6789 Rancho Court, subject to the conditions shown on Exhibit "B" attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
