<br />Resolution No. PC-95-32 <br />Page 2 <br /> <br />Several conditions have been included which would <br />restrict the hours of operation to minimize noise <br />and odor impacts, thereby ensuring that the use <br />will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the <br />properties or improvements in the vicinity. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />The home occupation is required to comply with the <br />conditions of this use permit and those stipulated <br />in Chapter 18.104.30. Additionally, other <br />conditions for the operation of the home occupation <br />have been included which further ensure compliance <br />with the zoning ordinance and its objectives. As <br />with any use permit, the home occupation permit can <br />be suspended or revoked if the conditions are not <br />met. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission finds that the proposed use, as <br />conditioned, is acceptable. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-95-21, the application of David Conkle <br />for a non-exempt home occupation permit to allow the <br />establishment of a small engine service and repair <br />business to be conducted from the existing residence <br />located at 6789 Rancho Court, subject to the conditions <br />shown on Exhibit "B" attached hereto and made part of <br />this case by reference. <br /> <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
