<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-95-32 <br /> <br />RESOLUTION <br />NON-EXEMPT <br />UP-95-21 <br /> <br />APPROVING THE APPLICATION OF DAVID CONKLE FOR A <br />HOME OCCUPATION PERMIT, AS FILED UNDER CASE <br /> <br />WHEREAS, David Conkle has applied for a non-exempt home occupation <br />permit to allow the establishment of a small engine <br />service and repair business to be conducted from the <br />existing residence located at 6789 Rancho Court; and <br /> <br />WHEREAS, zoning for the property is R-1-6500 District; and <br /> <br />WHEREAS, at its duly noticed public hearing of June 14, 1995, the <br />Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Chapters 18.32 and 18.36 permit home occupations to <br />be conducted in residences in the R-1 and RM zoning <br />districts, in accordance with Chapter 18.104 (Home <br />Occupations). Some of the objectives of the R-1 <br />and RM districts are to protect residential <br />properties from the hazards, noise, and congestion <br />created by commercial and industrial traffic, and <br />to protect properties from noise, illumination, <br />unsightliness, odors, dust, dirt and other <br />obj ectionable influences and hazards. The <br />objective of Chapter 18.104 is to permit certain <br />home occupations which will not adversely affect <br />the residential character of the neighborhood. <br />Conditions of approval for this non-exempt home <br />occupation permit have been included which restrict <br />the hours of operation to minimize noise and odor <br />impacts. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />
