PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-95-32

RESOLUTION
NON-EXEMPT
UP-95-21

APPROVING THE APPLICATION OF DAVID CONKLE FOR A
HOME OCCUPATION PERMIT, AS FILED UNDER CASE

WHEREAS, David Conkle has applied for a non-exempt home occupation
permit to allow the establishment of a small engine
service and repair business to be conducted from the
existing residence located at 6789 Rancho Court; and

WHEREAS, zoning for the property is R-1-6500 District; and

WHEREAS, at its duly noticed public hearing of June 14, 1995, the
Planning Commission considered all public testimony,
relevant exhibits and recommendations of the City staff
concerning this application; and

WHEREAS, the Planning Commission made the following findings:

A. The proposed location of the conditional use is in
accordance with the objectives of the zoning
ordinance and the purpose of the district in which
the site is located.

Chapters 18.32 and 18.36 permit home occupations to
be conducted in residences in the R-1 and RM zoning
districts, in accordance with Chapter 18.104 (Home
Occupations). Some of the objectives of the R-1
and RM districts are to protect residential
properties from the hazards, noise, and congestion
created by commercial and industrial traffic, and
to protect properties from noise, illumination,
unsightliness, odors, dust, dirt and other
obj ectionable influences and hazards. The
objective of Chapter 18.104 is to permit certain
home occupations which will not adversely affect
the residential character of the neighborhood.
Conditions of approval for this non-exempt home
occupation permit have been included which restrict
the hours of operation to minimize noise and odor
impacts.

B. The proposed location of the conditional use and
the conditions under which it would be operated or
maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious
to the properties or improvements in the vicinity.
