5. The owner shall install signs in the interior of the building on and/or near the exit <br /> doors stating that the customers shall not loiter outside the establishment and <br /> shall be courteous and quiet when leaving the business and parking areas. <br /> <br /> 6. The business owner/property owner or designated representative of the business <br /> shall maintain the area surrounding the restaurant/bar, outdoor areas, adjacent <br /> walkways, parking lots, and public sidewalks in front of and 100 feet therefrom <br /> the north and south limits of the structure, in a clean and orderly manner at all <br /> times. The public sidewalks and private property adjacent to the restaurant/bar <br /> shall be cleaned each morning prior to neighboring retail business hours. These <br /> areas shall be regularly monitored to ensure public peace and sanitary conditions. <br /> <br /> If non-compliant, the Planning Director may immediately suspend the <br /> conditional use permit. The Planning Commission shall hold a public heating <br /> within 40 days, and if not satisfied that the regulation, general provision or <br /> condition is being complied with, may revoke the use permit. <br /> <br /> 7. The outdoor patio shall be for dining only. No alcohol shall be consumed on the <br /> patio unless patrons are seated and eating a 'bona fide' meal served by waitstaff. <br /> Otherwise, alcohol service and consumption is allowed only within the physical <br /> building envelope. The owner(s) shall ensure that no alcoholic beverages are <br /> taken outside. <br /> <br /> The doors of the restaurant/bar shall remain closed when not being used for <br /> ingress/egress purposes. The applicant shall install self-closing door <br /> mechanisms on all exterior doors. <br /> <br /> If non-compliant, the Planning Director may immediately suspend the <br /> conditional use permit. The Planning Commission shall hold a public hearing <br /> within 40 days, and if not satisfied that the regulation, general provision or <br /> condition is being complied with, may revoke the use permit. <br /> <br /> 8. The property owner shall make a good faith effort to work with the neighboring <br /> property owner to repair the existing wooden fence located in the parking lot <br /> between 347-351 St. Mary Street and 446 St. John Street, and install a 6-foot <br /> chain link fence adjacent to it to prevent patrons from cutting through to gain <br /> access to 725 Main Street. The property owner shall a make a good faith effort to <br /> work with the neighboring property owner to maintain both fences in good repair <br /> and immediately repair any damage caused by patrons. <br /> <br /> 9. The business shall comply with State law, as well as Pleasanton Municipal Code <br /> about smoking in public and work places. <br /> <br /> 10. The owner shall comply with all regulations associated with the license issued by <br /> ABC. If non-compliant, the Planning Director may immediately suspend the <br /> conditional use permit.
