Exhibit A <br /> <br /> UP-88-17, Draft Conditions of Approval <br /> <br /> April 5, 2005 <br /> <br /> 1. The operation of a business at 725 Main Street serving alcohol after 10:00 shall <br /> conform to the requirements of UP-88-17 unless modified by the following <br /> conditions. <br /> <br /> 2. The owner shall ensure that the restaurant component fully complies with the <br /> existing conditional permit approval. Meals shall be served at all times that <br /> alcohol is served. The meals prepared may be a combination of hot and cold <br /> dishes and must be a 'meal' as defined by the Alcoholic Beverage Control Act <br /> (Business and Professions Code §23038) and be served by waitstaff. Microwave <br /> dishes as sole menu item(s) will neither be construed as 'meals' nor meet the <br /> definition of restaurant service. The owner shall provide a menu for review and <br /> approval by the Planning Director. <br /> <br /> If non-compliant, the Planning Director may immediatcly suspend the <br /> conditional use permit. The Planning Commission shall hold a public hearing <br /> within 40 days, and if not satisfied that the regulation, general provision, or <br /> condition is being complied with, may revoke the use permit. <br /> <br /> 3. The operation of the restaurant/bar shall be limited to the following hours: <br /> 11:00 am to 11:00 pm Sunday through Thursday; <br /> 11:00 am to 12:00 midnight Friday and Saturday. <br /> <br /> The restaurant/bar may remain open from 11:00 am to 1:00 am on New Year's <br /> Eve. <br /> <br /> If non-compliant, the Planning Director shall refer the conditional use permit to <br /> the Planning Commission. The Planning Commission shall hold a public <br /> hearing within 40 days, and, if not satisfied that the regulation, general <br /> provision, or condition is being complied with, may suspend or revoke the use <br /> permit. <br /> <br /> 4. The business owner and property owner will engage security personnel to the <br /> satisfaction of the Pleasanton Police Department and/or Planning Director. The <br /> security guard will keep weekly reports identifying the activities occurring on <br /> site and shall make available review of those reports when asked by the Police <br /> Department or any other City representative including the Planning Director or <br /> his designee. <br /> <br />SR:05:093 Page I of 3 /tpril 5, 2005 <br /> <br /> <br />
