Staff added two conditions of approval, adopted by the Pla~ing Commission, to address <br />and allay concerns about potential troublesome effects of serving alcohol until 2am. First, <br />is the condition that the use must conform substantially to the details of operation and <br />floor plan on file with the Planning Department. In the event that alcoholic beverage ser- <br />vice expanded significantly in the future, it is conditioned that the Planning Commission <br />may review and, if necessary, apply additional conditions to the subject use permit. <br /> <br />The second relevant condition of approval states that if, at any time, the ownership and/or <br />management of the restaurant is unable to control the activities of its patrons such that the <br />presence of the bar is determined to be a nuisance to surrounding uses or to the City in <br />general, the Planning Commission may review and, if necessary, revoke the subject con- <br />ditional use permit. <br /> <br />Although the business has been in continuous operation as the Union Jack Pub since ap- <br />proval of the use permit, ownership of the business has changed. On September 29, 1993 <br />Richard Ressler received zoning certificate approval for a change of ownership for the <br />Union Jack Pub. <br /> <br />Concerns and Issues: <br /> <br />For the past several years, surrounding property owners and tenants have brought com- <br />plaints over the Union Jack Pub due to issues of noise, vandalism, harassment, public <br />drunkenness, driving while under the influence, and other offensive behavior such as <br />public urination and vomiting by pub patrons. Because of the on-going reports of this be- <br />havior, potentially in violation of the use permit, it is appropriate for the Planning Com- <br />mission to review it at this time. <br /> <br />ANALYSIS <br /> <br />Neighboring property owners and tenants have been vocal in their opposition to the cur- <br />rent operations of the Union Jack Pub. The Police Department has received a variety of <br />service calls related to fights, bottle throwing, and other illicit activities involving Union <br />Jack Pub patrons. Per Maggie Wong, Crime Analyst for the Pleasanton Police Depart- <br />ment, the following is a breakdown of calls for service and patrol checks for the Union <br />Jack Pub for the year 2004.
