California Business and Professions Code, Section 23038. <br /> <br />BACKGROUND <br /> <br />During the December 8, 2004 Planning Commission Meeting under "Matters Initiated by <br />Commission Members," there was consensus among the Commissioners to bring thc con- <br />ditional use permit for the Union Jack Pub (UP-88-17) before the Planning Commission <br />as a public hearing to review the pub's compliance with the conditions of approval. Staff <br />has reviewed thc adopted conditions of approval, researched the public record, and found <br />evidence indicating the Union Jack Pub may not be fully adhering to the adopted condi- <br />tions. <br /> <br />The purpose of this report is to review the operations of the Union Jack Pub for compli- <br />ance with the conditions of approval of its use permit. As conditioned by UP-88-17, the <br />Planning Commission may conduct such review, and if necessary, apply additional con- <br />ditions to, or revoke, the subject conditional use permit. <br /> <br />On June 22, 1988, the Planning Commission approved conditional use permit UP-88-17 <br />for 725 Main Street, to operate a restaurant/bar known as the Union Jack Pub where alco- <br />hol could be served after 10:00 pm. The applicant represented the pub as an English-style <br />establishment offering imported beer, fish and chips, and other light meals. Kitchen ser- <br />vice would operate from 6 am to 9 pm, offering breakfast, lunch and dinner; bar service <br />would continue until 2 am. <br /> <br />When the usc permit application was made in 1988, the Pleasanton Downtown Associa- <br />tion (PDA) initially came out in opposition (see attachment 6) to the use permit over con- <br />cerns of an additional bar on Main Street and the associated problems of loitering, litter- <br />ing, public drinking, and, potentially, other undesirable behavior. The PDA eventually <br />supported the application, along with staff and the Planning Commission, after the appli- <br />cant assured that thc business would be run primarily as a restaurant, which is comple- <br />mentary to retail use and met the goals of the then draft Downtown Specific Plan. <br /> <br />Item 6. a., UP-88-17 Review Page 2 of 12 February 23, 2005 <br /> <br /> <br />
