Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />Tract 7193, Sycamore Heights, developed by Summerhill Homes, is a 48 lot single-family <br />residential subdivision located at the eastern terminus of Sycamore Creek Way and Sunset Creek <br />Lane, adjacent to Tract 6982, Bridle Creek. Summerhill was required to relocate an existing 24" <br />waterline and a portion of a 12" waterline, which were not located within the new roadway <br />extension of Sycamore Creek Way. <br /> <br />The 24" waterline meandered through several newly created lots of Sycamore Heights, including <br />portions of the Richey and Silveira properties. This 24" waterline was removed and replaced <br />with a new pipeline located within Sycamore Creek Way. The existing waterline easement for <br />this relocated waterline is no longer necessary. However, a portion of the 24"waterline will <br />remain within Lot 1 of Tract 7193. This portion of the waterline runs through Lot 1 on the west <br />side of the property within the existing waterline easement (coincident with the existing private <br />street, Dale Way). This waterline serves the Happy Valley area including the City golf course. <br />The City will not vacate this portion of the waterline easement. <br /> <br />The majority of the existing 12" waterline is within Sycamore Creek Way with the exception of a <br />small portion of the line affecting Lot 8 of the Sycamore Heights development. That portion of <br />the waterline crossing Lot 8 has now been removed and installed within Sycamore Creek Way. <br />Since Sycamore Creek Way is a dedicated public street, the original waterline easement is no <br />longer necessary. <br /> <br />Attachment A identifies those easements as described above that are to be vacated and those to <br />be retained. <br /> <br />DISCUSSION <br /> <br />The California Streets and Highways Code provides for an abbreviated, summary vacation <br />procedure for public easements under certain conditions, including when the easement has been <br />superseded by relocation and there are no other public facilities located within the easement. In <br />this situation, the waterlines have been relocated within a public right-of-way and the easements <br />are no longer needed for their intended purpose, with the exception of the easement running <br />through Lot 1 of Tract 7193, Sycamore Heights. <br /> <br />At this time, the next step would be for the City to vacate the easements by resolution, but <br />reserving a small portion of the easement through Lot 1 of Tract 7196 that is still needed. <br /> <br />SR 05:077 <br />Page 2 of 3 <br /> <br /> <br />
