<br />Resolution No. PC-95-30 <br />Page 8 <br /> <br />21. If the fencing to the west of the existing unit is not properly <br />located along the new property line as required by these <br />conditions, that fencing shall be relocated to provide for the <br />private open space. The fencing shall be a six-foot high solid <br />wood "good neighbor" fence and shall maintain a setback from the <br />front (Kottinger Drive) property line of at least 20 feet. <br /> <br />Specific Residential <br /> <br />22. This development plan shall be of no further validity and the <br />developer shall be required to submit the same or new development <br />plan for city approval prior to development of the site in the <br />event that the developer fails to record a final map within two <br />years of pun approval. <br /> <br />23. The developer shall provide all buyers with copies of the project <br />conditions of approval. <br /> <br />24. The developer shall record CC&R's at the time of recordation of <br />the final parcel map for the proposed two lots on this 10,474 <br />square foot site. The CC&R's shall be subject to the review and <br />approval of the City Attorney prior to recordation of the final <br />map. The CC&Rs shall define a party or parties responsible for <br />the maintenance of the driveway, private utilities, and other <br />common areas and facilities on the site, including all <br />landscaping and fencing. The CC&Rs shall grant the city the <br />rights and remedies, but not the obligation, to enforce the <br />maintenance responsibilities of the responsible parties as <br />defined in the CC&Rs. <br /> <br />Construction Activities <br /> <br />25. All site improvements and house construction activities shall be <br />limited to the hours of 8:00 a.m. to 5:00 p.m., Monday through <br />Saturday. All construction equipment must meet Department of <br />Motor Vehicles (DMV) noise standards and shall be equipped with <br />muffling devices. <br /> <br />26. At no time shall campers, trailers, motor homes, or any other <br />vehicle be used as living or sleeping quarters on the <br />construction site. All such vehicles shall be removed from the <br />site at the end of each work day. <br /> <br />27. Portable toilets used during construction shall be kept as far as <br />possible from existing residences and shall be emptied on a <br />regular basis as necessary to prevent odor. <br /> <br />28. The site shall be kept free of fire hazards from the start of <br />construction to final inspection. <br />
