<br />r <br /> <br />Resolution No. PC-95-27 <br />Page 4 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case UP-95-20 <br /> <br />1. The location and operation of the sports bar and country- <br />western dance club shall conform substantially as shown on the <br />site plan, floor plan, and applicants' operational statements, <br />Exhibit "A", dated "Received April 14, 1995" on file with the <br />Planning Department, except as modified by the following <br />conditions. Minor changes to the plans and operations may be <br />allowed subject to the approval of the Planning Director if <br />found to be in substantial conformance to the approved <br />exhibits. <br /> <br />2. Any proposed signs shall conform to the approved comprehensive <br />sign program for The Crossroads. The applicant shall submit <br />to the Planning Director for consideration under separate <br />application (sign design review) any proposed signs not in <br />conformance with that program. <br /> <br />Operational Conditions <br /> <br />3. If, at any time in the future, the activities of the operation <br />deviate from the those described in Exhibit "A", or the <br />ownership and/or management of the dance club and sports bar <br />are unable to control the activities of patrons either within <br />the bar/dance club itself or its patrons in the vicinity of <br />the bar/dance club such that the presence of the "Cadillac <br />Ranch" encourages loud noise, litter, parking lot problems, <br />drunkenness, etc. to the detriment of the surrounding uses or <br />to the city in general, the Planning Director may refer this <br />use permit to the Planning Commission for review at a public <br />hearing. If necessary, the Planning commission may add <br />conditions or revoke the subject conditional use permit per <br />Municipal Code section 18.124.130. <br /> <br />4. The applicant shall ensure that any Alcoholic Beverage Control <br />license(s) required to operate the sports bar/dance club are <br />kept current at all times and that any regulations or <br />restrictions associated with said license(s) are adhered to at <br />all times. Should the applicants allow any required <br />license (s) to lapse, or should the city become aware that <br />regulations or restrictions associated with said license(s) <br />are not being followed, the Planning Director may refer this <br />use permit to the Planning commission for review at a public <br />hearing. If necessary, the Planning Commission may add <br />conditions or revoke the subject conditional use permit per <br />Municipal Code section 18.124.130. <br /> <br />- <br />
