The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. The proposed school operations would be contained completely on-site. Sufficient parking and traffic capacity have been provided. Streets leading to the site are designed per City standards and are signalized to provide safe access into and out of the site. As conditioned, the proposed operation of the school would meet the occupancy and other requirements of the Pleasanton Municipal Code, Fire Code, and Uniform Building Code. The conditions of approval, as well as the applicant's proposed operations of the school, will ensure that the establishment remains within the standards of all applicable City codes. C. The proposed conditional use will comply with each of the applicable provisions of this chapter. Upon approval of the PUD modification, the site's PUD zoning will permit the establishment of private schools and colleges. The proposed school complies with all relevant sections of the zoning ordinance. Granting a conditional use permit to the University of Phoenix for operating a private post-secondary school is consistent with the City's ability to regulate zoning as listed in Municipal Code section 18.124 "Conditional Uses". WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning Commission determined that the proposed use would be compatible with the other uses in the business park. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: section l. Approves Case UP-95-11, the application of the University of Phoenix for a conditional use permit to operate a post-secondary school in an existing building located at 5725 West Las Positas Boulevard (Hacienda Business Park, site 23), subject to the conditions shown on Exhibit "B" attached hereto and made part of this case by reference.
