<br />Resolution No. PC-95-22 <br />Page 2 <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposed school operations would be contained <br />completely on-site. Sufficient parking and traffic <br />capacity have been provided. Streets leading to <br />the site are designed per City standards and are <br />signalized to provide safe access into and out of <br />the site. As conditioned, the proposed operation <br />of the school would meet the occupancy and other <br />requirements of the Pleasanton Municipal Code, Fire <br />Code, and Uniform Building Code. The conditions of <br />approval, as well as the applicant's proposed <br />operations of the school, will ensure that the <br />establishment remains within the standards of all <br />applicable City codes. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />Upon approval of the PUD modification, the site's <br />PUD zoning will permit the establishment of private <br />schools and colleges. The proposed school complies <br />with all relevant sections of the zoning ordinance. <br />Granting a conditional use permit to the University <br />of Phoenix for operating a private post-secondary <br />school is consistent with the City's ability to <br />regulate zoning as listed in Municipal Code section <br />18.124 "Conditional Uses". <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed use <br />would be compatible with the other uses in the business <br />park. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section l. Approves Case UP-95-11, the application of the <br />University of Phoenix for a conditional use permit to <br />operate a post-secondary school in an existing building <br />located at 5725 West Las Positas Boulevard (Hacienda <br />Business Park, site 23), subject to the conditions shown <br />on Exhibit "B" attached hereto and made part of this case <br />by reference. <br />
