<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-95-22 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF UNIVERSITY OF PHOENIX <br />FOR A CONDITIONAL USE PERMIT TO OPERATE A POST-SECONDARY <br />SCHOOL, AS FILED UNDER CASE UP-95-11 <br /> <br />WHEREAS, the University of Phoenix has applied for a conditional <br />use permit to operate a post-secondary school in an <br />existing building located at 5725 west Las Positas <br />Boulevard (Hacienda Business Park, site 23); and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- I-C/O "IPD" District; and <br /> <br />WHEREAS, at their duly noticed public hearing of April 12, 1995, <br />the Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The zoning for the business park is PUD - I/C-O <br />(Planned Unit Development - Industrial/Commercial/ <br />Office). The proposed uses for the site are those <br />of the IPD (Research & Development/ Light <br />Manufacturing) planning district in the Hacienda <br />Business Park which is currently being modified to <br />allow private schools and colleges as a condition- <br />ally permitted use. This would provide space for <br />semi-public facilities and institutions, such as <br />the proposed school, to locate in the Hacienda <br />Business Park, which would help to provide <br />professional educational facilities for the <br />businesses and workers in the Park. The conditions <br />of approval proposed for this project give the City <br />the appropriate controls to ensure that the use <br />does not have any negative impacts on the <br />surrounding businesses. The use permit for the <br />school is, as conditioned, in accordance with the <br />objectives of the zoning for this district. <br /> <br />. <br />
