<br />Resolution No. PC-95-13 <br />Page 2 <br /> <br />The proposed operation of the amusement devices <br />would be contained completely on-site inside the <br />existing Haps establishment. Sufficient parking <br />and traffic capacity are available for the <br />operation of the business establishment. No one <br />under the age of 21 years would be permitted to use <br />the amusement devices because they would be located <br />within a bar serving alcoholic beverages. The <br />conditions of approval, as well as the applicant's <br />proposed operations of the amusement devices, will <br />ensure that the establishment remains within the <br />standards of all applicable City codes. In <br />addition, the criteria of Chapter 6.04 of the <br />Municipal Code (Amusement Devices) will be met. <br />Therefore, the proposed operation of the amusement <br />devices would not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity <br />of the Haps establishment. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />The site's C-C zoning permits the operation of <br />establishments with amusement devices. The <br />proposed operation of amusement devices within the <br />existing Haps establishment complies with all <br />relevant sections of the zoning ordinance. <br />Granting a conditional use permit to Haps for the <br />operation of amusement devices within the existing <br />establishment is consistent with the city's ability <br />to regulate zoning as listed in Municipal Code <br />section 18.124 "Conditional Uses". <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning commission determined that the operation of <br />the amusement devices inside the existing Haps <br />establishment would be ancillary to and consistent with <br />the existing bar operation of the facility. <br /> <br />. <br />
