Resolution No. PC-95-13 Page 2 The proposed operation of the amusement devices would be contained completely on-site inside the existing Haps establishment. Sufficient parking and traffic capacity are available for the operation of the business establishment. No one under the age of 21 years would be permitted to use the amusement devices because they would be located within a bar serving alcoholic beverages. The conditions of approval, as well as the applicant's proposed operations of the amusement devices, will ensure that the establishment remains within the standards of all applicable City codes. In addition, the criteria of Chapter 6.04 of the Municipal Code (Amusement Devices) will be met. Therefore, the proposed operation of the amusement devices would not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity of the Haps establishment. C. The proposed conditional use will comply with each of the applicable provisions of this chapter. The site's C-C zoning permits the operation of establishments with amusement devices. The proposed operation of amusement devices within the existing Haps establishment complies with all relevant sections of the zoning ordinance. Granting a conditional use permit to Haps for the operation of amusement devices within the existing establishment is consistent with the city's ability to regulate zoning as listed in Municipal Code section 18.124 "Conditional Uses". WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning commission determined that the operation of the amusement devices inside the existing Haps establishment would be ancillary to and consistent with the existing bar operation of the facility. .
