That the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. As conditioned, the project will not be detrimental to the public health, safety and welfare because all City traffic, parking, separation, and noise standards, as well as state licensing requirements regarding the physical environment and operational standards will be met. C. That the proposed conditional use will comply with each of the applicable provisions of the zoning ordinance. The site's single-family residential zoning conditionally permits the establishment of large family day care homes, as defined by Municipal Code section 18.08.090. The proposed use complies with the large family day care standards listed in section 18.124.190 of the zoning ordinance, and meets all other relevant sections of the zoning ordinance. Granting a conditional use permit to Mrs. Phillips for a large family day care home is consistent with the city's ability to regulate zoning as listed in the Municipal Code Chapter 18.124 (Conditional Uses). WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning commission determined the operation meets the standards care homes as required by the Municipal Code. that, as conditioned, for large family day city of Pleasanton NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-94-77, the application of Jeffrey and Candy Phillips for a conditional use permit to operate a large family day care home (7-12 children) at the existing single-family dwelling located at 3444 Windsor Court, subject to the conditions shown on Exhibit "A" attached hereto and made part of this case by reference.
