<br />Resolution No. PC-95-10 <br />Page 2 <br /> <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />As conditioned, the project will not be detrimental <br />to the public health, safety and welfare because <br />all City traffic, parking, separation, and noise <br />standards, as well as state licensing requirements <br />regarding the physical environment and operational <br />standards will be met. <br /> <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the zoning <br />ordinance. <br /> <br />The site's single-family residential zoning <br />conditionally permits the establishment of large <br />family day care homes, as defined by Municipal Code <br />section 18.08.090. The proposed use complies with <br />the large family day care standards listed in <br />section 18.124.190 of the zoning ordinance, and <br />meets all other relevant sections of the zoning <br />ordinance. Granting a conditional use permit to <br />Mrs. Phillips for a large family day care home is <br />consistent with the city's ability to regulate <br />zoning as listed in the Municipal Code Chapter <br />18.124 (Conditional Uses). <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, <br /> <br />the Planning commission determined <br />the operation meets the standards <br />care homes as required by the <br />Municipal Code. <br /> <br />that, as conditioned, <br />for large family day <br />city of Pleasanton <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-94-77, the application of Jeffrey and <br />Candy Phillips for a conditional use permit to operate a <br />large family day care home (7-12 children) at the <br />existing single-family dwelling located at 3444 Windsor <br />Court, subject to the conditions shown on Exhibit "A" <br />attached hereto and made part of this case by reference. <br />
