<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-95-10 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO OPERATE A <br />LARGE FAMILY DAY CARE HOME, AS FILED UNDER CASE UP-94-77 <br />(AP-95-01) <br /> <br />WHEREAS, the Zoning Administrator approved Case UP-94-77, the <br />application of Jeffrey and Candy Phillips for a <br />conditional use permit to operate a large family day care <br />home (7-12 children) at the existing single-family <br />dwelling located at 3444 Windsor Court; and <br /> <br />WHEREAS, zoning for the property is R-1-6,500 single-family <br />residential District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal <br />Code, the decision was appealed by several adjacent <br />residential neighbors; and <br /> <br />WHEREAS, at their duly noticed public hearing of February 8, 1995, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Objectives of the zoning ordinance include: <br />protecting existing land uses from inharmonious <br />influences and harmful intrusions; fostering <br />harmonious, convenient, workable relationships <br />among land uses; and insuring that public and <br />private lands ultimately are used for the purposes <br />which are most appropriate and beneficial to the <br />City as a whole. As conditioned, the proposed <br />large family day care would be consistent with <br />these objectives, because it would retain the <br />residential characteristics of the neighborhood due <br />to its limited scale and size. The subject site is <br />zoned R-1-6,500 Single-Family Residential District. <br />Large family day care homes are allowed in single- <br />family residential districts subject to the <br />standards in the Municipal Code. Therefore, the <br />use permit for the large family day care is in <br />accordance with the objectives of the zoning <br />district. <br />
