The Arroyo Del Valle and private park shall be owned and maintained as one parcel by the <br />homeowners association. <br /> <br />93. In the event that additional work is required for the banks of the Arroyo Del Valle beyond <br />that which was anticipated by the geotechnical reports and PUD development plan, a <br />detail description of this work shall be submitted to the City Engineer and Planning <br />Director for review prior to any such activities. The City Engineer and Planning Director <br />shall determine whether said work is consistent with the scope of work identified in the <br />geotechnical reports and PUD development plan. If the work is not consistent, additional <br />review, which may include a PUD modification and environmental review, may be <br />required. <br /> <br />94. The developer shall conduct the first year maintenance activities, in accordance with the <br />approved Arroyo Del Valle maintenance plan. In addition, the developer shall to the best <br />of their ability obtain a long-term permit from the Department of Fish & Game to allow <br />the eventual maintenance of the creek area by the homeowners association. The developer <br />shall continue the yearly maintenance activities until the homeowners association's <br />responsibilities are completely assumed by the future private homeowners. <br /> <br />95. Developer shall obtain all necessary permits for work within the Arroyo Del Valle from <br />the Army Corps of Engineers and Department ofFish and Game. <br /> <br />96. Developer shall remove all foreign debris and fallen trees within the Arroyo Del Valle as <br />required by the City Engineer. <br /> <br />97. The homeowners association, or developer, shall provide to the City Engineer an annual <br />report detailing the condition, required maintenance, and slope repairs for the homeowner <br />association's property within the Arroyo Del Valle. The City Engineer may require that <br />portions of the report by prepared by a registered civil engineer to address identified <br />engineering concerns. <br /> <br />98. All existing overhead lines within the subdivision shall be removed or installed <br />underground. The overhead lines which cross the arroyo are not required to be installed <br />underground. One riser shall be behind Lot # II and the mini-park area along the creek <br />bank. <br /> <br />99. Building foundation shall be setback from the toe of the Arroyo Del Valle a minimum <br />distance to provide a 2 to I slope bank plus 20 feet unless foundations are designed to <br />accommodate a lesser setback recommended by the soils engineer and approved by the <br />Director of Building and the City Engineer. <br /> <br />PUD-94-04 <br /> <br />Planning Commission Conditions Of Approval <br /> <br />Page 12 of 13 <br /> <br />. <br />
