<br />In response to Chairman Lutz, Mr. Iserson advised that if this were a permanent facility, the <br />applicant would be required to install paving and oil separators. He further noted that staff is <br />willing to allow a "status quo" situation for the next few years before a determination of a <br />permanent solution is made. <br /> <br />In response to Commissioner Hovingh, Mr. Beougher noted that the intent of Condition 5 <br />gives the City the right to on-site inspection. Otherwise, the City would need to get an <br />inspection warrant before entering the property. <br /> <br />Mr. Iserson concurred that the applicant should be made responsible that no leaking vehicles <br />are stored on the site. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Eric Lauritsen, 2512 Vineyard Avenue, described that his company is a distribution point for <br />all garbage trucks sold in Northern California. They perform all in-service work before <br />delivering the trucks. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Hovingh commented that he would like to add that leaking vehicles are strictly <br />prohibited and any clean-up costs should be borne by the applicant. Commissioner Wright <br />does not agree with this addition, noting that there has been no contamination found in the <br />past through City inspections. <br /> <br />Discussion ensued regarding the topic of vehicle leakage. Mr. Beougher advised that the <br />City does not police these sites and act only on filed complaints. If a complaint is received <br />regarding a leakage problem, Condition 5 allows staff to inspect the site. <br /> <br />Commissioner Hovingh motioned, seconded by Commissioner Wright, making the <br />conditional use permit findings and approving Case UP-95-66, subject to the conditions <br />of approval listed in Exhibit B, with the following modification: <br /> <br />Condition 5: Add: More than incidental leakage from stored vehicles or <br />containers is strictly prohibited. <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Barker, Hovingh, McGuirk, Wright and Chairman Lutz <br />None <br />None <br />None <br /> <br />Planning Commission Minutes <br /> <br />Page 6 <br /> <br />December 13, 1995 <br />
