<br />During the motion, there was considerable discussion regarding the requirement of entrance <br />and exit gates as well as the expense of repairing the concrete in the parking lot. <br /> <br />Commissioner Hovingh motioned, seconded by Commissioner Wright, making the <br />conditional use permit findings and approving Case up-95-54, subject to the conditions <br />of approval listed in Exhibit "B," with the following modifications: <br /> <br />Condition 18: Remove second sentence. <br /> <br />Condition 23: No pinball games, video games or pool tables are allowed. <br /> <br />Condition 24: Parking lot to be treated with a slurry seal, striping, lighting and <br />speed bumps to be added, and the entrance and exit to be clearly delineated. <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Barker, Hovingh, McGuirk, Wright and Chairman Lutz <br />None <br />None <br />None <br /> <br />Resolution No. PC 95-76 was entered approving Case UP-95-54, as motioned. <br /> <br />d. Robert and Suzanne Earnest <br />Appellant: Anthony and Mary Ann Cravotta <br />Appeal of the decision of the Zoning Administrator's approval for design review and a <br />variance from the Municipal Code to allow the construction of a 15 foot tall gazebo <br />within the front yard of a single-family lot located at 17 Foothill Lane. Zoning for the <br />property is R-I-20,000 (single-family residential) District. <br /> <br />Mr. Iserson presented the staff report for the appeal of a decision by the Zoning <br />Administrator to approve a design review and variance to allow a 15 foot tall gazebo within <br />the front yard of the single-family lot located at 17 Foothill Lane. The variance would allow <br />a five foot encroachment into the building setback. The gazebo is nearly complete at this <br />time. <br /> <br />It will have to be determined if the roofing material, which is proposed to be wood shake, <br />meets the fIre resistive roofing ordinance before any building permits are issued. Staff also <br />believes that the lO-inch finial is allowable under the Code. <br /> <br />Mr. Iserson explained the details of the original approval for the design review and variance <br />granted by the Zoning Administrator. Staff noted the Cravotta's (appealing neighbors) <br />opposition to the location and overall height of the gazebo.
