<br />Staff provided for the Commission a three lot alternative for the 1.01 acre parcel. This <br />alternative has been included as a condition of approval. <br /> <br />The applicant proposed the following modifications to the conditions of approval: <br /> <br />Condition 6: The developer does not believe he should be required to grant land or easement <br />to Mr. Jones. He believes the requirements for a prescriptive use have not been fulfilled. <br />Staff does not completely agree with the applicant's point of view, however, they have <br />modified the condition of approval to simply require that the developer resolve this matter <br />prior to tentative map approval. <br /> <br />Condition 8: This condition required the owner of Lot 9 to remove the portion of Ernest <br />Jones's driveway which is located on Lot 9 should Mr. Jones's easement be abandoned. The <br />applicant would prefer to leave this up to the discretion of the owner of Lot 9. However, <br />with the new three-lot alternative, this point is moot. If the Commission decides to keep the <br />four-lot lotting plan, staff would recommend that a provision be added that the driveway <br />surface could be kept subject to administrative design review. <br /> <br />The applicant has requested two additional conditions: <br /> <br />The first request is a reduction in the number of new street trees per lot for each existing tree <br />which is saved. The second request is for reimbursement for oversizing the water main to be <br />installed in Rose Avenue to accommodate other development outside the Rose Avenue area. <br />Staff feels these requests are appropriate and have added such conditions. <br /> <br />Staff has attempted to develop a comprehensive master land use plan for all of the parcels. <br />Staff included in the staff report two alternatives to the circulation pattern, as noted in <br />Attachments 7 and 8. <br /> <br />Mr. Plucker then outlined the three alternatives available to them in their approval decision. <br />Staff recommends the Commission recommend approval of the PUD rezoning and a 12-10t <br />development plan to the City Council. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Commissioner Hovingh noted that he had met with the developer. <br /> <br />Chairman Lutz noted that he was not at the August 9th meeting but has read the Minutes and <br />feels he can participate in this decision. <br /> <br />Lynn Jansen, Lynden Homes, 481 Kingswood Lane, Danville, stated that they have taken the <br />time since the last meeting to work further with the applicant, staff, and neighbors. <br /> <br />Planning Commission Minutes <br /> <br />Page 16 <br /> <br />September 27, 1995 <br />
