Commissioner Dove advised that he had spoken with Ms. Harden. He is concerned about
the separation of Safeway from Walgreen's and the impact this may have on Walgreen's
business. Ms. Harden advised that Walgreen's is not concerned with the relocation of
Safeway and is very pleased with the development plans.

Commissioner Barker stated her belief that it is beneficial to both the shopping center and the
park to have an access to the park. Commissioner Wright feels the new configuration of the
center no longer has the small shops which would benefit from the park foot traffic. He
does not agree to a pedestrian access behind the store. Mr. Pavan advised that the Director
of Parks and Recreation also concurred with the closing of the access believing it
inappropriate for the park patrons to use the service/delivery area behind Safeway. Mr.
Swift noted the center's owner has also had concern about the public use of the center's
service area.

Commissioner Wright motioned, seconded by Commissioner Hovingh, finding the
project would not have a significant effect on the environment and approving the draft
Negative Declaration prepared for Case Z-95-126.

ROLL CALL VOTE
AYES: Commissioners Barker, Dove, Hovingh, Wright and Chairman Lutz
NOES: None
ABSENT: Commissioner McGuirk
ABSTAIN: None

Resolution No. PC-95-57 was entered approving the draft Negative Declaration, as
motioned.

Commissioner Wright motioned, seconded by Commissioner Hovingh, approval of Case
Z-95-126 subject to the conditions listed in Exhibit B with the following modifications:

Condition 21D: Delete "truck deliveries."

Add Condition 25D: Limit construction hours from 8 a.m. to 6 p.m. Monday
through Saturday, and all construction equipment must meet the DMV noise
standards and be equipped with muffling devices.

ROLL CALL VOTE
A YES: Commissioners Dove, Hovingh, Wright and Chairman Lutz
NOES: Commissioner Barker
ABSENT: Commissioner McGuirk
ABSTAIN: None

Resolution No. PC-95-58 was entered approving Case Z-95-126, as motioned.

Planning Commission Minutes

Page 6

August 23. 1995
