Mr. Plucker noted that the reference to <br />a soundwall should be deleted from Condition 15. <br /> <br />In response to CommissionerHovingh, Mr. Plucker noted that the farm house of Anita <br />Davidson would be removed. <br /> <br />In response to Commissioner Barker, Mr. Higdon stated that Rose Avenue's size is the <br />City's minimum street size. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Lynn Jansen, Lynden Homes, 481 Kingswood Land, Danville, represented this application. <br />The speaker briefly described the project and the project architecture. Mr. Jansen gave an <br />overview of the discussions, meetings, etc. with Mr. Jones regarding his easement. Mr. <br />Jones had been unwilling to negotiate regarding his easement. <br /> <br />Mr. Jansen noted that they have worked closely with Zone 7 and have met their <br />requirements. Also, no driveway of the development backs out onto Rose Avenue. The <br />landscaping will coordinate with that existing in the adjacent development. The mature <br />existing trees will be incorporated as street trees in the development. Mr. Jansen discussed <br />the street layout with or without the Rose Avenue extension. The house design is that of a <br />country farmhouse with large porches across the front and back. <br /> <br />Mr. Jansen briefly gave some background regarding their discussions of the benefits of this <br />development and the easement with Mr. Jones. Mr. Jones indicated that the easement was <br />his land and nothing was going to be done to it. Mr. Jansen tried to move forward, <br />however, working with staff. At the very least, Mr. Thompson's rights included turning the <br />easement into a public street. <br /> <br />Mr. Jansen had a few conditions he wanted to discuss. <br /> <br />Condition 5: The applicant would be willing to provide Mr. Jones with a driveway to Rose <br />Avenue such that he would not have to change his address in lieu of the $1,000 <br />reimbursement requested by Mr. Jones. Mr. Jansen feels $250 is a reasonable payment for <br />Mr. Jones to change his address. <br /> <br />Condition 6: Mr. Jansen is willing to talk to Mr. Jones about the encroachment of his <br />driveway over Lot 13. Mr. Jansen feels that over time Mr. Jones' driveway shifted over <br />what is now the comer of Lot 13. He feels the staff report contends that Mr. Jones has a <br />prescriptive right to it.
