(Condition 8). <br /> <br />As part of the original PUD, the walnut trees were to be preserved in the development. The <br />trees have since been removed because they were dead or dying. However, staff encouraged <br />the applicant to incorporate a double row of pear trees in their street tree planting plan to <br />create the look of a walnut orchard. <br /> <br />Staff is also recommending elimination of the entry features to the development because there <br />is no Homeowners Association and because of the expense of a lighting district to the <br />homeowners. <br /> <br />Staff is recommending approval of the PUD major modification and the design review. <br /> <br />Commissioner Wright inquired if Condition 12 is enforceable to have homeowners install <br />landscaping within nine months when there is no Homeowners Association. Mr. Iserson <br />advised that it is up to the City to enforce this condition. <br /> <br />Commissioners McGuirk and Wright discussed with staff their intent of wrapping the front <br />elevation articulations around to the side elevations. <br /> <br />Mr. Swift advised that the appeal to the City Council of the approval of the granny flats by <br />the Planning Commission is not for review or discussion at this meeting. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Frederick Bates, New Cities Development Group, 9781 Blue Larkspur Lane, Monterey, <br />spoke to the three issues yet to be resolved; he is in agreement with all other issues. <br /> <br />In response to a comment by Commissioner Wright regarding enforcing the required owner <br />landscaping, Mr. Bates stated they will propose to offer a landscape plan to the homeowners <br />or a dollar credit in lieu of the landscaping. However, if the landscaping is not installed <br />within a set time period, the homeowner would lose the $5,000 landscape allowance. New <br />Cities Development feels this will eliminate enforcement by the City. <br /> <br />Mr. Bates then discussed the entry feature, which staff feels should be eliminated. The <br />applicants would like to have an entry feature, but because the development is small, they <br />didn't want to have a lighting district and homeowners association. They feel the property <br />owners with the entry feature monuments on their properties would have enough pride of <br />ownership to keep up the entry monuments.
