<br />6. PUBLIC HEARINGS <br /> <br />a. UP-95-24. U.S. TOWin!! <br />Application for a conditional use permit to allow operation of tow-service and vehicle <br />impound lot on the rear portion of a site located at 3932 Old Santa Rita Road. Zoning <br />for the property is PUD (Planned Unit Development) - C-S (Service Commercial) <br />District. <br /> <br />Mr. Swift presented the staff report for the application for a conditional use permit to operate <br />a tow company storage yard and office at 3932 Old Santa Rita Road, recommending <br />approval, subject to the conditions of approval in Exhibit B. <br /> <br />Mr. Swift advised that this is an interim conditional use permit valid for one year. Ifthe <br />applicant wishes to continue operating from this site, he will be required to make certain site <br />improvements such as paving the site, completing street improvements, etc. <br /> <br />Commissioner Hovingh is concerned about wrecked cars leaking oils into the ground and <br />inquired about the use of an oil separator. Mr. Swift feels oil separators are beneficial only <br />in paved lots. Staff also feels there will be minimal leaching into this dirt and gravel site <br />over the one year period. Commissioner Hovingh inquired if a condition of approval <br />requiring site cleanup before vacating the premises would be appropriate. Staff felt this <br />would be acceptable, as well as restricting wrecked cars on the premises. <br /> <br />Commissioner Dove inquired if a time limit should be added regarding the length a car is on <br />the premises, as well as clarifying the number of night-time deliveries of automobiles. Staff <br />noted that there will be very few night-time deliveries of automobiles and noted the staff <br />report stated a maximum of five night-time deliveries per month. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />There were no public comments. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Hovingh motioned, seconded by Commissioner Wright, making the <br />conditional use pennit findings and approving Case UP-95-24, subject to the conditions <br />of approval listed in Exhibit B, with the following modification: <br /> <br />Condition 4: Add "No vehicle is to be stored for longer than 45 days." <br /> <br />Condition 7: "...(up to five)..." is changed to "...(up to five per month)". <br /> <br />Planning Commission Minutes <br /> <br />Page 2 <br /> <br />July 12, 1995 <br />
