<br />~ PUD-95-01. Parvis & Holi Ghorbani <br />Application for Planned Unit Development rezoning and development plan approval to <br />create two separate lots each with one single family residential unit (two houses are <br />existing) on an existing lot located at 4262 First Street. Zoning for the property is RM- <br />2500 District. <br /> <br />Mr. Iserson presented the staff report for the application for a planned unit development <br />rewning to PUD-HDR and development plan approval to create two separate lots from an <br />existing 10,474 sq. ft. lot with two single family homes. The property had a development <br />plan previously approved for condominiums; however, this project was never built. A fire <br />had destroyed one of the two existing houses, and the applicant came to the City requesting <br />design review approval to build a replacement house. That house is currently under <br />construction. The applicant also applied for a minor subdivision. The applicant expressed a <br />desire to subdivide the property to have separate ownerships which was not possible with the <br />multi-family residential zoning. A PUD zoning is, therefore, required for such a <br />subdivision. Based on the fact that a similar situation exists further up Kottinger Drive, staff <br />feels this application is acceptable, and recommends the Commission approve Case <br />PUD-95-01. <br /> <br />Chairman Wright noted Conditions 7 and 8 require the CC&R's to prohibit parking of boats, <br />campers, and trailers on the site, as well as prohibit parking vehicles in the driveway. He <br />would like the conditions of approval to so state that such parking is prohibited. Mr. Iserson <br />noted that was the original intent. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Mazi Ghorbani, 11469 Rothschild Place, Dublin, noted he agrees with all conditions of <br />approval. Mr. Ghorbani advised that the good neighbor fencing has been replaced at his <br />expense. Further, he noted that 20-30 feet of the First Street fencing is destroyed by the <br />overgrowth from the rental property owned by Mr. Safreno. So far, nothing has been done to <br />repair or replace this fence. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />With continued discussion of the good neighbor fencing, Mr. Ghorbani indicated on the site <br />plans which fencing had been replaced and which fencing was destroyed by the adjoining <br />overgrowth. <br /> <br />A motion was made by Commissioner Hovingh, seconded by Commissioner Lutz, <br />making the PUD findings for the proposed development plan and recommending <br />approval to the City Council of Case PUD-95-01, subject to the conditions of approval <br />listed in Exhibit B. <br /> <br />Planning Commission Minutes <br /> <br />Page 9 <br /> <br />May 24, 1995 <br />
