<br />,- <br /> <br />Condition 7: Mr. Churka does not agree with this condition at all. He does not want a <br />future owner having a condition on his properly which would degrade the value of the <br />property. Chairman Wright advised the applicant that this condition only applies if there is <br />agreement to combine the two adjoining parking lots. <br /> <br />Condition 9: Regarding the use of the basement for storage purposes only, Mr. Churka had <br />previously discussed that the basement would also be used for access to utility maintenance <br />as well as periodic appliance repair. <br /> <br />Condition 13: Mr. Churka is not in agreement with the two foot right-of-way and is still <br />discussing this issue. <br /> <br />Condition 22: Chairman Wright clarified that this condition applies to all of the landscaping <br />Mr. Churka installs. Mr. Iserson advised that "street trees" can be deleted from this <br />condition. <br /> <br />Conditions 26 and 28: Mr. Churka is unsure of the meaning of these two conditions and is <br />unwilling to agree to them. <br /> <br />Condition 31: Staff advised that this condition applies to the fact that the site plan and <br />grading plan have two different elevations, and they need to be brought into conformance. <br /> <br />Condition 45: Mr. Churka noted that another construction project close by is working until <br />10 p.m. He does not wish to be constrained by these time periods. In response to <br />Commissioner Barker, he would like to start excavation in two months; however, it may not <br />happen until May of 1996. Mr. Churka would agree to time limits for outdoor noise, but not <br />inside construction projects. The Commission advised that this is another standard condition. <br />Chairman Wright believes the time constraints would not be necessary for indoor activities <br />once the windows and doors were installed to mitigate any noise problems. <br /> <br />Condition 46<1: States a need for covered areas on the site for storage of cement, paints, <br />oils, pesticides, etc., and Condition 47 prohibits the use of trailers. Chairman Wright <br />advised the applicant that the trailers referred to living or sleeping trailers. <br /> <br />Condition 51: Regarding the non-guarantee of availability of sufficient water, Chairman <br />Wright noted this is a standard condition. Commissioner Barker clarified with staff that this <br />instance has never happened. <br /> <br />Condition 54: Regarding the slope of the parking lot, Mr. Churka does not want to be <br />required to match the slope of the neighboring parking lot. Chairman Wright feels the issue <br />of joining the parking lots in the future will address any differences in the parking lot slopes <br />at that time. <br /> <br />Planning Commission Minutes <br /> <br />Page 5 <br /> <br />May 24, 1995 <br />
