The Commissioners discussed the front door issue, feeling that if there is a parking problem,
the applicant may want to move the main entrance off the rear parking lot. Mr. Swift
commented he believes this business will have less of a parking problem than Sh-Boom.

Commissioner Barker commented that she would not want to put a condition on the
application restricting the use of live bands. Chairman Wright interpreted the condition was
to disallow the use of regular, nightly live bands.

A motion was made by Commission Hovingh, seconded by Commissioner Dove, making
the conditional use permit fmdings and approving Case UP-95-20, subject to the
conditions of approval listed in Exhibit B.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Hovingh, Dove, McGuirk, Barker and Chairman Wright
None
Commissioner Lutz
None

Resolution No. PC-95-27 was entered approving Case UP-95-20, as motioned.

L. MATTERS INITIATED BY COMMISSION MEMBERS

Commissioner Hovingh inquired if the City still subsidize the sewer connections for Main
Street restaurants. Mr. Swift stated the City does make loans to downtown restaurants. The
fee for a restaurant going into a previously retail area is quite high. Commissioner Hovingh
feels there are too many restaurants downtown.

Commissioner Dove commented that he was troubled with last meeting's appearance that
nothing the Planning Department did was right. He is concerned that this is setting a
precedence. The Commissioners discussed the situation, all agreeing that the Downtown
Guidelines need to be reviewed and applied whenever possible.

Commissioner Barker inquired if staff could take the green directional signs with Ruby Hill
logos down since they are in violation of the sign ordinance. Staff advised that a memo had
been sent to the concerned parties, with no response as of yet. Commissioner Barker
requested that the signs be taken down until the issue is resolved.

8...
