<br />Resolution No. PC-2004-61 <br />Page Two <br /> <br />2. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The existing beauty salon is located in a shopping center that has a variety of <br />retail businesses, including, but not limited to, general retail shops, franchise <br />businesses, furniture stores, copying center, etc. As conditioned, serving beer and <br />wine to salon clients would not generate any adverse impacts upon other <br />businesses and patrons of the shopping center. The subject site has ample parking <br />available for its patrons. In addition, the shopping center provides adequate <br />on-site circulation within the shopping center and sufficient ingress and egress to <br />and from the shopping center. <br /> <br />The serving of beer and wine has been conditioned to adhere to all requirements <br />ofthe Alcoholic Beverage Control agency. A condition of approval has been <br />added to allow the review and possible revocation of this use permit should the <br />use result in any adverse impacts to the public health, safety, and general welfare. <br />The City's Police Department has reviewed the applicant's proposal and does not <br />believe that it would result in any adverse impacts. Therefore, this finding can be <br />made. <br /> <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br /> <br />Based on the proposal and staffs analysis of this proposed use and ABC licensing <br />requirements, the granting of a conditional use permit for the proposed use would <br />be consistent with the City's ability to regulate zoning regulations. Therefore, this <br />finding can be made. <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-127, the application of Karen Marcum, Plush Beauty Bar, <br />for conditional use permit to serve wine and beer in an existing beauty salon <br />located at 4001 Santa Rita Road; subject to the conditions shown in Exhibit "B," <br />attached hereto and made part ofthis case by reference. <br /> <br />. <br />
