PC-2004-61 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF KAREN MARCUM, PLUSH <br />BEAUTY BAR FOR CONDITIONAL USE PERMIT, AS FILED UNDER CASE PCUP-I27 <br /> <br />WHEREAS, Karen Marcum has applied for conditional use permit to serve wine and beer in an <br />existing beauty salon located at 4001 Santa Rita Road; and <br /> <br />WHEREAS, zoning for the property is C-C (Central Commercial) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of October 13,2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations ofthe <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Enviromnental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose ofthe district in which <br />the site is located. <br /> <br />The objectives of the zoning ordinance include fostering a harmonious, <br />convenient, workable relationship among land uses, protecting existing land use <br />from inharmonious influences and harmful intrusions, and insuring that public <br />and private lands ultimately are used for the purposes which are most appropriate <br />and beneficial to the City as a whole. The proposed use is an incidental use to an <br />existing beauty salon. In addition, the salon would have trained personnel serving <br />beer and wine to salon clients in a desigoated area. Based on the proposal and <br />discussion in the staff report concerning land use and compliance to the Alcoholic <br />Beverage Control (ABC) agency's requirements, no potential adverse land use <br />issues are expected to result from the proposed beer and wine bar. Thus, this <br />finding can be made. <br /> <br />. <br />
